Dairy products exported from the U.S. and imported into Chile, China, the European Union (EU), India, and the United Kingdom (UK) are subject to establishment listing requirements as a precondition for market access. Please note that the scope of products for which importing authorities impose listing requirements may differ from FDA's definition of “milk product” as established in 21 CFR 1240.3(j). To determine whether products intended for export are subject to listing requirements, exporters may consult the regulatory authorities in the country to which they intend to export or the Food and Agricultural Import Regulations and Standards Reports (FAIRS) for their export destination. FAIRS are published by the United States Department of Agriculture's Global Agricultural Information Network.

Industry may request inclusion on the dairy export lists and update existing listing information via the Export Listing Module (ELM). Please visit Online Applications for Export Lists for a link to this electronic system and step-by-step instructions. More information on specific country requirements is included below.

In addition to establishment listing requirements, Chile, China, the EU, India, and the UK require sanitary certificates as a condition of entry for every shipment of dairy products. Industry may contact the United States Department of Agriculture, Agricultural Marketing Service, Dairy Grading Branch to request these certificates.

Additional Information on Dairy Exports to India

  • Effective September 01, 2024, India will only accept U.S. dairy exports from establishments that are registered with India via inclusion on a dairy export list provided by FDA and published by FSSAI. Prior to exporting, industry should consult India’s list of approved establishments to verify that the establishment from which they intend to export is listed.
    • Effective September 01, 2024, India will only accept export certificates signed after an establishment has been added to the list published on India’s website and the list has entered into force.
  • Please note that Food Safety and Standards Authority of India (FSSAI) recommends that establishments consider the intended use of products intended for export to determine whether the manufacturer is subject to registration and listing requirements for dairy products.
    • Establishments should be included on India’s list of approved establishments if they intend to manufacture dairy products for export to India that are intended for use as (or in) food or nutraceuticals including whey and lactose products. 
    • Establishments do not need to be included on this list if they solely intend to manufacture dairy products for export to India intended for use as (or in) pharmaceuticals. 
    • If the intended use is unknown, FSSAI recommends that the establishments register via inclusion on the dairy export list. 
  • To prevent shipment delays at the border, FSSAI recommends that establishments clearly document the intended use on export documents, such as:
    • “Intended for human consumption, food”
    • “Intended for human consumption, nutraceuticals”
    • “Intended for pharmaceutical use”
