FDA-Korea MOU Extension Amendment 12/6/21

EXTENSION
OF THE
MEMORANDUM OF UNDERSTANDING BETWEEN THE FOOD AND DRUG ADMINISTRATION, DEPARTMENT OF HEALTH AND HUMAN SERVICES OF THE UNITED STATES OF AMERICA
AND THE
MINISTRY OF OCEANS AND FISHERIES OF THE REPUBLIC OF KOREA
COVERING THE SAFETY AND QUALITY OF FRESH AND FRESH FROZEN MOLLUSCAN SHELLFISH EXPORTED FROM THE REPUBLIC OF KOREA TO THE UNITED STATES OF AMERICA

Whereas the Food and Drug Administration (FDA), Department of Health and Human Services of the United States of America and the Ministry of Oceans and Fisheries (MOF) of the Republic of Korea (collectively, the Participants) wish to maintain the long standing cooperation on the safety and quality of fresh and fresh frozen molluscan shellfish exported from the Republic of Korea to the United States begun through the Memorandum of Understanding Between the Food and Drug Administration Department of Health and Human Services of the United States of America and the Ministry of Oceans and Fisheries of the Republic of Korea Covering the Safety and Quality of Fresh and Fresh Frozen Molluscan Shellfish Exported from the Republic of Korea to the United States of America, signed on November 24, 1972 (1972 MOU); and

Whereas the cooperative activities were renewed under the Memorandum of Understanding between the Food and Drug Administration of the United States of America and the Ministry of Maritime Affairs and Fisheries of the Republic of Korea concerning the sanitary control of fresh frozen molluscan shellfish destined for exportation from the Republic of Korea to the United States of America, signed at Washington and Rockville on the 28 of October, 1998; and

Whereas the cooperative activities were renewed under the Memorandum of Understanding Covering the Safety and Quality of Fresh and Fresh Frozen Molluscan Shellfish exported from the Republic of Korea to the United States of America done at Washington and Rockville on the 28th of October, 2003; and

Whereas the cooperative activities were renewed under the Memorandum of Understanding Covering the Safety and Quality of Fresh and Fresh Frozen Molluscan Shellfish exported from the Republic of Korea to the United States of America, signed at Washington and Sejong-si on the 22nd of May 2015 and the 15th of June 2015 (2015 MOU) and were to continue for a period of five years expiring on the 15th of June, 2020; and

Whereas the Participants desire to extend the cooperative work under the 2015 MOU in promoting the safety of public health and to ensure the safety and quality of fresh and fresh frozen molluscan shellfish exported to the United States of America from the Republic of Korea; and

Whereas section VII of the 2015 MOU provides that the MOU may be extended for specified periods by written consent of both Participants;

The Participants consent to extend the 2015 MOU for a period of three (3) years with effect from June 15, 2020 through June 15, 2023.
