FDA Releases Vending Machine Labeling Guidance Documents

The U.S. Food and Drug Administration (FDA) announced today the availability of a Small Entity Compliance Guide (SECG) and draft guidance to help businesses comply with the agency’s final rule on calorie labeling for vending machine foods.

The final rule, “Food Labeling: Calorie Labeling of Articles of Food in Vending Machines,” was published in the Federal Register on December 1, 2014. The rule implements the vending machine labeling provisions of the Affordable Care Act that require disclosure of calorie information at the point of purchase for food sold by persons who own or operate 20 or more vending machines.

The SECG is intended to help small businesses comply with the rule and restates the requirements of the final rule in plain language. The draft guidance provides additional information and responds to frequently asked questions about the vending machine labeling requirements. We request electronic or written comments on both the SECG and the draft guidance. Information about submitting comments is described in the notices of availability at the links below.
