Drug Residue Injunctions and Related Actions

An injunction is a civil judicial process initiated to stop or prevent violation of the law, such as to halt the flow of violative products in interstate commerce, and to correct the conditions that caused the violation to occur. If a firm has a history of violations, and has promised correction in the past but has not made the corrections, the injunction is more likely to succeed. However, the freshness of the evidence is critical.

When an injunction is granted, FDA has a continuing duty to monitor the injunction and to advise the court if the defendants fail to obey the terms of the injunction decree.  If the injunction is violated, the agency should consider what action, including a possible civil or criminal contempt of court action action, is warranted.
