Is the new owner of a facility responsible for inspection findings found during an MQSA inspection that was conducted when the previous owner was in control?

Under MQSA, an owner/operator of a mammography facility is always responsible for the activities of that facility. If inspection findings for problems found during an MQSA inspection continue under the new management, these findings(s) must be addressed by the new management, regardless of who owned the facility when the MQSA inspection was conducted. The fact that a change in ownership takes place does not relieve the current owner of his or her responsibilities under MQSA. Therefore, if the findings have not been addressed by the previous facility management, then the new management must address the issue(s). Facility personnel must take whatever corrective action is needed to bring the facility up to the standards required by MQSA and to assure that the problems will not continue.
