Deliveries to private individuals
The cost of an agent is also related to the requirement that even private individuals must report private deliveries, and therefore the producers of the food stuffs concerned are required to be registered. At the same time, those producers may not be aware of the exports of their produce to the U.S. Therefore, deliveries by international mail should be excluded from the scope of the Act, be it by private individuals or companies delivering to private individuals. This would be in line with the practice that food stuffs brought to the U.S. by private persons for private consumption are not subject to the registration and notice requirements of the BTA.
While these concerns may not be addressed within the existing authority of FDA, the European Commission would like to invite you to include these issues among those that need to be addressed in amendments to the original Act and would like to encourage you to report to Congress on these concerns so that it can take the necessary steps to amend the Act accordingly.
