Under the DSHEA the FDA has plenty of authority to regulate dietary supplements. As the DSHEA has only just begun to be fuly implemented, wisdom would dictate that we allow existing legislation to do the work for which it was intended before resorting to new legislation. The DSHEA provides the right balance between freedom of choice for the consumer and protecting the public from unsafe products with false or misleading claims.
