1. General Comments I am writing as a small business owner who could be affected greatly by whatever decisions are taken by our congress. I will not repeat the message that our organization, the NNFA wants us to relay to you: The FDA already has enough legislative authority to regulate supplements. Instead, I will tell you that I am afraid of knee-jerk reactions on the part of our appointed members of congress. For 8 years you have allowed the FDA to avoid dealing with its responsibilities towards the American people, and the Nutritional industry. I believe there are issues with certain supplements, especially ephedra, but giving the FDA more power rewards them for 8 years of not doing their assigned task, and places us on the unfortunate situation of slowing down the new product to market process. Before more power is given, the FDA must work with the powers you have given them. Not doing so sets a precedent where they avoid mandates until they agree with them, and this is not their task. Their task is to follow the will of congress, and the will of the American people. The FDA hid behind bureocracy and did not act quickly enough to deal with ephedra on a fact-based approach.
