They have given corporations the rights of persons even though corporations are not persons. They have defined advertising as “commercial speech”. They then can expand constitutional protections for advertising. However, they don’t address the fact that the constitution does not protect the right of persons to injure the health and even destroy lives of other persons. Advertising is propaganda which is different from speech because propaganda is a powerful tool to manipulate the buying habits of persons by distorting, misrepresenting and hiding facts. The facts are that the products they are selling are injurious and dangerous to health and life. Therefore, It is of extreme importance that the FDA retain its power to control advertising (“commercial speech”). Advertising of alcohol and gambling should be restricted.
