The Food Certification Program staff at the American Heart Association support the publication of a final rule regarding the “10% nutrient contribution requirement” (a.k.a. the “jelly bean” rule) as applied to health claims, and believe that this should be designated an “A” priority in the FY 2003 CFSAN Program Priorities.  It is our understanding that this is a component of the current “B” priority entitled, “Develop a final rule providing for more flexibility in the use of health/nutrient content claims in response to citizen’s petition (2.2.4.d).”
