Dear Mr. Manney,

Preferred Freezer Services FFD located on 231 Elm St, in Perth Amboy, NJ received a warning letter (File#07-NW-J-12) from your organization on June 26, 2007. We responded to this letter via written correspondence on two occasions and there was still some confusion amongst Preferred, our customers, and the FDA on what temperature documentation is needed on receipts of refrigerated crabmeat containers.

In order to devise a conclusion that was agreeable to all parties, Preferred voluntarily facilitated a meeting with the FDA and one of our refrigerated crabmeat customers on November 29, 2007 at our Preferred Freezer Services Elm St. location. We discussed the temperature recording procedures needed to ensure compliance with section CFR Part 123 of our HACCP plan.

At the meeting all parties agreed that Preferred will place product on hold during situations where a refrigerated crabmeat container does not have printed temperature documentation on the container and only an electronic TTR. Preferred will immediately overnight the electronic TTR to the customer and release the product from the hold when we receive a faxed copy of the temperature reading verifying that the temperature of the product is in compliance with our HACCP receiving procedures. This procedure was instituted immediately following the meeting and has become part of our standard operating procedures for receipts of refrigerated crabmeat containers.
