Chocolate Cottage Warning Letter Response

September 29, 2006

Food and Drug Administration
Denver District Office
6th Avenue & Kipling Street
Denver, Colorado 80225-0087

As a follow-up to my letter of May 15th 2006 which we provided correct revisions to 4 specific ingredient labels, our Rocky Road, Cherry Cordial, Haystack, and Cottage fudge labels to Ms. B. Belinda Collins & Mr. William H. Sherer, l have produced this letter to advise that new labels have been printed for the 4 products listed. These are correct revisions due to the fact that I followed the instructions and food labeling guide given to me by Mr. Brent W. Higgs, an investigator from your office assigned to our business. I also had verbal approval during a telephone conversation with Mr. Sherer on June 19th 2006.

In August 2006 the revised labels were ordered through a labeling company and the labels were delivered to us approximately the 15th week of September. In August of 2006 Mr. Sherer advised that this follow-up letter could be posted on the internet next to the warning letter which was sent to our company on April 25, 2006 and posted on the internet. We have made every effort to be in compliance with our product labeling.

Sincerely,
Gary Smart, Co-owner, Chocolate Cottage
Sandy, Utah
