20.88 Agreements
The Division of Federal-State Relations coordinates 20.88 confidentiality agreements for State and local government agencies. This agreement is limited to the FDA's streamlined program to share non-public food safety information. Under the streamlined procedures, FDA can rapidly share non-public information, including confidential commercial information and FDA predecisional information, with local and State agencies responsible for food inspection programs and laboratories regarding food-related product information, inspections, enforcement actions, and foodborne illness investigation data and traceback information.
All agreements expire on December 31 and are renewed for a period of three years. Original signatures are required by all persons who receive non-public information.
