The food contact substance is 2-propenoic acid, polymer with one or more comonomers of 2 propenoic acid, n butyl ester; 2-propenoic acid, tert-butyl ester; 2-propenoic acid, 2 ethylhexyl ester; 2-propenoic acid, hydroxypropyl ester; 2-propenoic acid, 2-methyl-, methyl ester; 2 propenamide; benzene, ethenyl-; and acetic acid ethenyl ester.

Attached is the Finding of No Significant Impact (FONSI) for FCN 865. After this notification becomes effective, this FONSI and the notifier's environmental assessment, dated September 29, 2008, may be made available to the public and we will post them on the internet where they can be accessed from the Food Ingredients and Packaging section under the Food topic of www.fda.gov.

Finding of No Significant Impact

 

A food contact notification (FCN No. 865), submitted by BASF SE, to provide for the safe use of 2-propenoic acid, polymer with one or more comonomers of 2 propenoic acid, n butyl ester; 2-propenoic acid, tert-butyl ester; 2-propenoic acid, 2 ethylhexyl ester; 2-propenoic acid, hydroxypropyl ester; 2-propenoic acid, 2-methyl-, methyl ester; 2 propenamide; benzene, ethenyl-; and acetic acid ethenyl ester as a component of pressure-sensitive adhesives used as the food-contact surface of labels and tapes applied directly onto food.

The Environmental Review Team has determined that allowing this notification to become effective will not significantly affect the quality of the human environment and therefore will not require the preparation of an environmental impact statement. This finding is based on information in the notification, including an environmental assessment, dated September 29, 2008, submitted by the notifier and other information known to the agency.
