The SRI International Corp submitted a letter on February 18, 2005, on behalf of Occidental Chemical Corporation, requesting that Food Additive Petition 8B4571 be converted to a Food Contact Notification. The converted petition was designated as Food Contact Notification No. 495.

The environmental reviewer for the Food Additive Petition, Mark Hepp, prepared a memorandum dated November 18, 1998, stating the following:

"In a letter dated November 16, 1998, the petitioner submitted a claim for a categorical exclusion under 21 CFR 25.32(q). I have reviewed the claim and conclude that it is warranted. The claim of categorical exclusion cites the section under which the categorical exclusion is claimed, includes a statement of compliance with the categorical exclusion criteria, and includes a statement that the petitioner knows of no extraordinary circumstances that require submission of an environmental assessment. Therefore, neither an environmental assessment nor an environmental impact statement is required."

Mark Hepp was assigned to be the environmental reviewer for FCN 495. He determined that the FIFRA label for the FCS for the proposed use was current and concluded that the claimed categorical exclusion was still warranted.
