Attached is the Finding of No Significant Impact (FONSI) for this Premarket Notification. When this notification becomes effective, the following environmental documents should be made public:

1. This FONSI.
2. A copy of the revised Environmental Assessment (EA) dated October 15, 1999, from FAP 8B4564, but with the new first page that was submitted later. There are attachments cited in the EA (see tabs). Please make sure that they are attached to the copy of the EA that is made public. If you need assistance in identifying these documents, I will be happy to help you.

Please let us know if there is any change in the identity or use of the food-contact substance that would be inconsistent with the identity and use described in the FONSI.

Finding of No Significant Impact

A Premarket Notification (FCN No. 000005), submitted by BP Amoco Chemicals, Inc., to provide for the safe food contact use of nitrile rubber modified acrylonitrile-methyl acrylate copolymers to fabricate bottles intended as containers for beverages as defined in 21 CFR 170.3(n)(3), 35), and (36) with the exception of soft drinks and coffee substitutes.

The Environmental Review Team, Division of Product Manufacture and Use, has determined that allowing this notification to become effective will not significantly affect the quality of the human environment and therefore will not require preparation of an environmental impact statement. BP Amoco originally requested this action in a food additive petition (FAP 9B4564). The notice of filing for that petition appeared in the Federal Register on February 4, 1998 (63 FR 5808). The food contact use requested in FCN 000005 is the same as that requested in FAP 9B4564. Therefore, the information presented in the Environmental Assessment for FAP 9B4564 is applicable to this notification, and this finding is based on that information.
