Subject: 2011 Revision of the Grade "A" Pasteurized Milk Ordinance
The 2011 Revision of the Grade “A” Pasteurized Milk Ordinance (PMO), which includes provisions from the Grade “A” Condensed and Dry Milk Products and Condensed and Dry Whey - Supplement I to the Grade “A” PMO, has been completed and an electronic version (CD) will be provided to the State Regulatory and Rating Agencies. A hard copy will be provided to the printers and will be available for general distribution at a later date.
The 2011 Procedures Governing the Cooperative State-Public Health Service/Food and Drug Administration Program of the National Conference on Interstate Milk Shipments document, Section IX., Application of Conference Agreements, A., Implementation of Changes, 2. states: “.. The changes involved, that have been concurred with shall be effective within one (1) year of the electronic publication of the affected documents or notification to the States by IMS-a, following the Conference at which the changes were approved.” By transmittal of this Memorandum of Information (M-I-12-2), this is the formal announcement of the electronic publication (CD) of the PMO. Therefore, for those States that are not able to officially adopt the changes to the PMO through the issuance of IMS-a-48 (Actions of the 2011 National Conference on Interstate Milk Shipments), the effective date for the changes to the PMO is January 19, 2013. For those States that can officially adopt the changes to the PMO through the issuance of IMS-a-48, their effective date remains November 7, 2012 as cited in IMS-a-48.
When the electronic version is posted on the FDA Web Site and when the printed copies of the 2011 Revision of the PMO are available for distribution an M-I will be issued announcing the availability of the document.
An electronic version of this memorandum is available, and the PMO document when received, should be distributed to Regional Milk Specialists, State Milk Regulatory Agencies, State Laboratory Evaluation Officers and State Milk Sanitation Rating Officers
in your region. The electronic version should be widely distributed to representatives of the dairy industry and other interested parties and will be available on the FDA Web Site at http://www.fda.gov at a later date.
