AUTHORITY TO APPROVE OUTSIDE ACTIVITIES

1. AUTHORITY DELEGATED.

The Assistant Commissioner for Management, as the Deputy Ethics Counselor, hereby delegates authority to approve or disapprove HHS-520 "Request for Approval of Outside Activity," except as reserved in Limitations below.

2. TO WHOM DELEGATED.

Director, Ethics and Integrity Staff

All previous delegations of authority inconsistent with the provisions of this delegation are superseded.

3. LIMITATIONS.

The Commissioner reserves the authority to approve the following:

A. Requests to provide consultative or professional services to organizations, including governments that have been awarded a Federal grant or contract or that have applied for such.

B. Participation in litigation as an outside activity, either by providing testimony or other consultative services if the case is one in which the Government is or is likely to be a party; in which the Government has requested or is likely to request leave to serve as friend of the court (amicus curiae); or in which the Government is known to have a substantial interest.

4. REDELEGATION AND CERTIFICATION.

This authority may not be redelegated.

5. EFFECTIVE DATE.

Kimberly Holden, Assistant Commissioner for Management (Operations), approved this delegation, via memorandum, on March 1, 2010.
