AUTHORITY TO PRESCRIBE AND FURNISH UNIFORMS AND OTHER SPECIAL WEARING APPAREL

1. AUTHORITY DELEGATED.

To prescribe uniforms to be worn by civil service personnel in the performance of their official duties under 5 U.S.C. 5901; to prescribe wearing apparel, as authorized by 42 U.S.C. 227, for personnel concerned with carrying out the purposes of the Public Health Service Act; and to furnish uniforms and wearing apparel prescribed under the authority above or to authorize payment of a uniform allowance under 5 U.S.C. 5901 for such uniforms.

2. TO WHOM DELEGATED.

The Principal Deputy Commissioner; Deputy Commissioners, Direct Reports to the Commissioner; Associate Commissioner for Regulatory Affairs; Center Directors and Deputies; Center Associate Directors for Management; Director, Office of Management, CDER; Director, Office of Resource Management, ORA; Director, Office of Regional Operations, ORA; Director, Division of Import Operations and Policy, ORA; and the Director, Office of Executive Operations, OC.

All previous delegations of authority inconsistent with the provisions of this delegation are superseded.

3. REDELEGATION AND CERTIFICATION.

This authority may be redelegated. Any redelegation must be in writing and specify the nature and extent of the authority redelegated. Delegatees must be certified as knowledgeable about the legal, regulatory, and policy requirements regarding prescription of uniforms.

A copy of the redelegation of this authority must be furnished to the Director, Office of Management Programs (OMP) and the FDA Principal Delegation Control Officer, OMP. Delegatees are subject to compliance audits.

4. EFFECTIVE DATE.

The Deputy Commissioner for Administration approved this delegation, via memorandum, on January 29, 2010.
