AUTHORITY TO ACCEPT GIFTS UNDER TITLE XXI OF THE PHS ACT

1. AUTHORITY DELEGATED.

Under Section 231 of the PHS Act (42 U.S.C. 238), as amended, the authority to accept gifts, excluding gifts of real property, insofar as it applies to the functions of the agency.

2. TO WHOM DELEGATED.

Commissioner of Food and Drugs.

All previous delegations of authority inconsistent with the provisions of this delegation are superseded.

3. LIMITATIONS.

Offers of personal property shall not be accepted if the total costs associated with acceptance are expected to exceed the cost of purchasing a similar item (including the cost of normal care and maintenance).

4. REDELEGATION AND CERTIFICATION.

This authority may be redelegated. Delegatees must be certified as knowledgeable about the legal, regulatory, and policy requirements regarding financial management.

A copy of the redelegation of the authority must be furnished to the Director of the Office of Financial Operations (OFO); Director, Office of Financial Management, OFO; Director, Office of Financial Services, OFO; and to the FDA Principal Delegation Control Officer, OMP. Delegatees are subject to compliance audits.

5. EFFECTIVE DATE.

Russell J. Abbott, Deputy Commissioner for Administration, approved this delegation, via memorandum, on January 8, 2010.
