AUTHORITY TO MAKE INITIAL DECISIONS TO GRANT OR DENY REQUESTS FOR WAIVERS OF CLAIMS FOR ERRONEOUS OVERPAYMENTS OF PAY, ALLOWANCES, AND OF TRAVEL, TRANSPORTATION, AND RELOCATION EXPENSES UNDER 5 U.S.C. 5584

1. AUTHORITY DELEGATED.

A. To approve requests for waivers of overpayment;

B. To approve requests for waivers of interest and administrative fees;

C. To make recommendations for approval or denial of requests for waivers of overpayment;

2. TO WHOM DELEGATED.

A. Items 1.A. and 1.B. are delegated to the Assistant Commissioner for Management (Operations).

B. Item 1.C. is delegated to the Director, Office of Management Programs.

All previous delegations of authority inconsistent with the provisions of this delegation are superseded.

3. LIMITATIONS.

The authority to act on requests for reconsideration of denials is retained by the Associate General Counsel, Office of the General Counsel, Department of Health and Human Services.

4. REDELEGATION AND CERTIFICATION.

This authority may not be further redelegated.

5. EFFECTIVE DATE.

The Deputy Commissioner for Administration approved this delegation, via memorandum, on December 2, 2009.
